Court resets fouled up furlough

A 31 year old Mitchell man awaiting a furlough from jail ended up in front of Judge Chris Giles after some apparent confusion. Giles granted Nicholas Tischler a four-hour furlough earlier this week to see his three-month old son for the first time at his mother’s home in Mitchell. However an apparent communication breakdown led jail officials to stop the furlough.

It began when a deputy asked Tischler’s mother several questions regarding details of the furlough that she wasn’t aware of. Tischler told the court he wasn’t allowed to use a phone or I-pad to communicate. He says he lost his temper and felt, in his words, “everything closed in on me.”

Tischler also complained he wasn’t receiving the medications he needed.

Giles asked Tischler’s attorney Dava Wermers to help set up the four-hour furlough over deputy states attorney Bob O’Keefe’s objection. He ordered Tischler to PBT and UA when he left the jail and when he returned. He also ordered the jail to transport him to a medical appointment on Monday. Giles warned Tischler, in these words, “don’t mess this up.”
