Mitchell Police arrest two people for shooting and illegal drugs

On Wednesday July 11, 2018, at approx. 2:05 a.m., The Mitchell Department of Public Safety Dispatch center received a report of a silver colored pickup that was chasing a silver car in the 1300 block of W. Havens Avenue in Mitchell.  The caller stated that it sounded like there were gunshots fired and the vehicles left Eastbound at a high rate of speed.

At approx. 2:13 a.m., a Mitchell Police Officer found the silver colored pickup near the area of the intersection of 12 Avenue and Rowley St.  The vehicle contained one male occupant.

At approx. 0300 hrs. Mitchell Police Officers located the silver car that was apparently involved in this incident.  The vehicle was found in the parking lot located at 901 W. 8th Avenue.  Officers then located Bernard Jesse Drapeau III and Malissa Nicole Garmong by the silver car.  Officers detained Drapeau and Garmong.  A .40 caliber handgun was located on the ground in the area of Drapeau.  A scale with apparent methamphetamine residue was found on Drapeau’s person.  A plastic bag containing approx. 2.8 ounces of apparent methamphetamine was found on the ground by Garmong.  Three small plastic baggies containing 5 grams or less of methamphetamine were found on Garmong’s person.  Hydrocodone, Oxycodone and Alprazolam pills were also found on Garmong’s person.

During this incident, it appeared that Garmong walked to Drapeau’s vehicle that was parked in a parking lot located on the 1300 block of West Havens Avenue, and Garmong entered the vehicle.   It appeared that a third person who drove the siver pickup, drove up to Drapeau’s vehicle and the silver pickup struck Garmong’s vehicle that was parked by Drapeau’s vehicle.  It appeared that Garmong and Drapeau drove away from the parking lot in one vehicle, while the silver pickup followed. During this incident, it appears that Drapeau shot one round from a .40 caliber handgun at the silver pickup, while driving in the 1300 block of W. Havens Avenue and that Drapeau fired one round from his vehicle in approx. the 800 block of West Havens Avenue.  The two vehicles travelled to the area of 12th Avenue and Rowley Street in Mitchell, where Drapeau allegedly fired a third round at the silver pickup.  Nobody was injured during this incident.  It does not appear that property was struck by the rounds that were fired.

 

As a result of this investigation, 36 -year-old Mitchell resident, Bernard Jesse Drapeau, date of birth 05-07-82, was arrested for the following offenses:

-Unauthorized Possession of a Schedule 1 or 2 Controlled Substance in violation of S.D.C.L. 22-42-5

-Aggravated Assault in violation of S.D.C.L. 22-18-1.1

-Discharge of a Firearm at an Occupied Vehicle in violation of S.D.C.L. 22-14-20

-Possession of Firearm By Person Convicted of Felony Drug Crime in violation of S.D.C.L. 22-14-15.1

-Reckless Discharge of a Firearm in violation of S.D.C.L. 22-14-7

-Carrying Concealed Pistol Without a Permit in violation of S.D.C.L. 22-14-9

-Reckless Driving in violation of S.D.C.L. 32-24-1

-Driving With a Suspended Driver’s License in violation of S.D.C.L. 32-12-65.2

-Substitution of License Plates in violation of S.D.C.L. 32-5-103

27 year old Mitchell, SD resident Malissa Nicole Garmong, date of birth 08-14-90, was also arrested for the following offenses:

-Unauthorized Possession of a Schedule 1 or 2 Controlled Substance in violation of S.D.C.L. 22-42-5

-3 Counts of Unauthorized Possession of a Schedule 3 or 4 Controlled Substance in violation of S.D.C.L. 22-42-5

Unauthorized Possession of a Schedule 1 or 2 Controlled Substance is a Class  5 Felony punishable by 5  years imprisonment in the state penitentiary and or a fine of $10,000  on each count.   Aggravated Assault  and Discharge of a Firearm at an Occupied Vehicle are Class 3 Felonies punishable by 15  years imprisonment in the state penitentiary and or a fine of $30,000 on each count.   Possession of Firearm by One With a Prior Drug Conviction and Unauthorized Possession of a Schedule 3 or 4 Controlled Substance are class 6 felonies punishable by 2 years imprisonment in the state penitentiary and or a fine of $ 4,000 on each count.   Reckless Discharge of a Firearm, Reckless Driving, Carrying a Concealed Pistol  and Substitution of License Plates are all  Class 1 Misdemeanors punishable by  up to one year  imprisonment in a county jail  and/or a fine of $2,000 on each count.  Driving With a Suspended Driver’s License is a Class 2 Misdemeanor punishable by  up to 30 days  imprisonment in a county jail  and/or a fine of $500 on each count
