The lawyer representing farmers in a suit against a county confined animal feeding operation (CAFO) regulation says a judge’s ruling is pending on whether to dismiss the suit. Media reports Tuesday erroneously said two of eight counts in the suit were dismissed. Attorney Brent Haden says that’s not the case.
“He did not say he was dismissing counts one and four,” Haden told Brownfield Ag News Tuesday, referring to the judge hearing arguments from both sides Monday.
